My contribute to the big 3 bailout!

Post by joerg »

A friend of mine and me decided to visit the casino named Mohegan Sun here in CT. Just came home and we really had a lot of fun down there! After loosing 100 bucks at the roulette table i had to get something to drink! So we both got to the bar and ordered two beers! The waiter told us if we are playing the machines at the bar we do not have to pay for the drinks. So i put 100 bucks into the machine and played some kind of stupid slot game! I didn´t know how it works an just pushed a few buttens! After i hit max bid the thing deducted me 80 bucks for one time of spinning!   I got a little mad but the next second it said JACKPOT.
I won 1248 bucks for pushing one button! :) :) :) The display of the machine said i have to get an attendant for the cashout after pushing cashout button!
The guy came up to me and asked for my driver´s license and all my informaton! He took off and came back after 20min and came back with 810 bucks. I asked where the rest is and he told me that they had to take the rest for taxes because i´m not a resident of the US     My friend and i started to laugh our asses off and told him that we´re proud to get a chance to support the big 3 now!   I felt soooo pissed!

With those 438 bucks i could have bought a lot of things in here, but for know i will even send the 810 bucks back to my account in austria! How can a nation ask me for taxes without me having a citizenship? That´s big BS. That´s a thing u get and see nowhere else on the world! And i have been to a lot of countries and know that for sure!

Gambling income of residents (as defined by treaty) of the following foreign countries is not taxable by the United States: Austria, Czech Republic, Denmark, Finland, France, Germany, Hungary, Ireland, Italy, Japan, Latvia, Lithuania, Luxembourg, Netherlands, Russian Federation, Slovak Republic, Slovenia, South Africa, Spain, Sweden, Tunisia, Turkey, Ukraine, and the United Kingdom.

Claimants must give you a Form W-8BEN (with a valid U.S. Taxpayer Identification Number (TIN)) to claim treaty benefits on gambling income that is not effectively connected with a U.S. trade or business.

You're from Austria... it's first on the list

It means that if you fight it they will suck that other $800 from you in legal fees and then you will get nothing. The govment always wins.

You would get the money back from the IRS somehow.

Here is the form:
http://www.irs.gov/pub/irs-pdf/fw8ben.pdf

Sometimes they have these forms at the airport as well. You fill it out, mail it back with receipts and whatever proof you have, and you get your sales tax refunded. Not sure if they do that in America or not, but I can do it when I travel to most other countries.

I am trying to find some less vague articles on the process, since the IRS documents are like moon language to me...

http://www.articlesbase.com/finance-art ... 60086.html
Foreign nationals such as residents of Canada and the United Kingdom may be exempt from paying tax and be subject to a full casino tax refund due to provisions within their tax treaties with the United States. It is advised for Foreign Nationals claiming tax treaty provisions to use the services of an IRS Certifying Acceptance Agent to effect a US tax recovery.
And more confusing... (but this is for Canadians, which might have a specific treaty)

Is the 30% tax paid on gambling winnings in the US refundable to a Canadian resident?

All of it is refundable if you lost as much as you won. Part is refundable if you lost part of your winnings and none of it is refundable if you won a lot and did not lose anything more which would be me. I have likely put $50.00 into slots since 1998. If I had won $10,000, the iRS would get their 30% because I would not have put any of it back into the system.

Entire legal agencies exist to try and get the withheld gambling winnings from American casinos. Taxing winners and all the legal bullshit around it is big business.
